Mane and James Krivda, Givaudan's former vice president over its perfumery department, told the Third Circuit to let stand a New Jersey federal jury's February 2014 verdict which found that Krivda Plaintiff Givaudan Fragrances Corporation ("Plaintiff" or "Givaudan") brings this action against Defendants Mane and James Krivda ("Krivda") alleging that Krivda stole 616 of Givaudan's fragrance formulas, which Givaudan contends are trade secrets, before he left his employment at Givaudan to join the ranks of Mane in 2008. The motion for The case dates back to 2008 when fine fragrance perfumer James Krivda left Givaudan to work for a competitor, Wayne-based Mane USA.Attorney Adam Saravay, a partner at McCarter & English who Givaudan also seeks an Order compelling Mane to comply with the Court's February 15, 2013 Order. See Givaudan's Brief at p. 17. Givaudan's request is improper, as it did not seek leave from the Court to file a motion to compel on this issue. See dkt. no. 343. In addition, Givaudan has already filed a Motion for Civil Contempt and the Imposition Givaudan sued a former employee, Appellee James Krivda, and his new employer, Appellee Mane USA, Inc., claiming Krivda stole more than six hundred fragrance formulas before leaving its employ. Litigation has been ongoing since September of 2008.
